MSC Activates “End of Voyage” Clause for Cargo Bound for the Arabian Gulf

MSC has implemented an “End of Voyage” mechanism for all cargo destined for ports in the Arabian Gulf, rerouting vessels to designated safe ports and imposing a surcharge of USD 800 per container. 

Escalating tensions in the Middle East are generating significant risks for maritime supply chains serving the Gulf region. In this context, shipping lines are compelled to invoke special contractual provisions to safeguard vessel operations and mitigate operational risks.

Mediterranean Shipping Company (MSC) announced that the End of Voyage clause will apply to all cargo currently within its transport system, including containers at terminals, shipments already at sea, and empty containers released for export loading to ports within the Arabian Gulf. Cargo presently in transit will be diverted to the nearest safe discharge port. At the designated port, containers will be discharged and made available to customers for cargo clearance and onward inland transportation. 

According to MSC’s official notice, the measure has been adopted in response to extraordinary circumstances unfolding in the Middle East, which are directly affecting maritime operations and access to Gulf ports. For affected shipments, a mandatory surcharge of USD 800 per container will be levied to offset costs associated with vessel deviation. 

In addition to this surcharge, all expenses arising from cargo discharge at the alternative port will be borne by the cargo owner. These costs include container handling, storage, and any related charges incurred. Such expenses are governed by the terms and conditions set forth in the MSC Sea Waybill or Bill of Lading, particularly Clause 13 concerning Special Circumstances. 

Customers wishing to forward their cargo to an alternative final destination will be required to arrange a new booking through MSC’s standard agency channels. Clients are advised to contact their local MSC office for details regarding the designated discharge port and procedures for cargo retrieval. 

MSC stated that the activation of the End of Voyage clause is necessitated by circumstances beyond the company’s control and expressed its expectation of customer cooperation during this period of heightened uncertainty.
